On March 31, 2026, Saltz Mongeluzzi Bendesky, together with co-counsel Arnold & Porter Kaye Scholer LLP, filed a nationwide class action in the United States District Court for the Eastern District of Pennsylvania alleging that Penske Truck Leasing Co., L.P. engaged in widespread business practices that harmed its full-service commercial truck leasing customers.
The lawsuit follows an extensive investigation into allegations that businesses across the country paid for a level of service they did not receive while also being charged for expenses that, according to the complaint, Penske was contractually obligated to bear. The complaint further alleges that customers experienced prolonged truck downtime, unexpected service charges, and automatic withdrawals for disputed charges, resulting in significant operational and financial harm.
As alleged in the complaint:
“Plaintiff brings this nationwide class action to address and rectify Penske’s abusive business practices that harm its thousands of full-service lease customers. Penske has a pattern and practice of overcharging these customers, including Plaintiff, for service work on trucks that are Penske’s contractual responsibility, causing unreasonable and excessive downtime in the diagnosis and repair of trucks for which the customers continue to pay, and prematurely auto-debiting customers for service charges.”
The lawsuit seeks class certification and compensation on behalf of businesses nationwide that leased commercial trucks under Penske’s full-service lease agreements and were allegedly harmed by these practices. The litigation is ongoing.
